1. How To Enter:
"National Thank You Day" Contest ("Contest") begins 10:00 am Central Time ("CT") on July 1, 2008 and ends 3:00 pm CT on August 15, 2008 ("Promotion Period"). During the Promotion Period, visit www.nationalthankyouday.com and click on the Contest link. You will be prompted to submit an essay, nominating one person who you feel deserves a special thank you for a simple good deed done or a daily act of kindness and why he/she deserves it. You will also need to include in your essay, a prize (with a retail value up to $20,000) that you think the Nominee would want and that you feel would express a heartfelt "thank you" for his/her good deed or act of kindness. Essays must not exceed 150 words, or entry will be disqualified. Once you have submitted your essay, you must complete the online registration form. All Nominators who submit an eligible entry will receive a downloadable coupon for one free 8.8 oz. box of merci Finest Assortment of Chocolate when you buy one 8.8 oz. box at regular price. Entry must be complete and eligible to receive the coupon. All entries must be received by 3:00 pm CT on August 15, 2008. Limit one entry per person. Normal Internet access, phone/usage charges imposed by your online/phone service will apply. Please note: you must notify the Nominee to let him/her know you are entering on his/her behalf.
2. Random Drawings/Judging:
A random drawing will be conducted halfway through the Contest and at the end of the Contest to determine the entries that will move onto the judging round. The first random drawing will be conducted on or about July 23, 2008 from among all eligible entries received up to that date. The second random drawing will be conducted on or about August 16, 2008 from among all eligible entries received from July 23, 2008 through the end date. Random drawings will be conducted by Administrator. Two thousand, five hundred (2,500) entries will be selected in each random drawing, provided that there are at least that many eligible entries received. If, at the time of either drawing, the number of eligible entries received does not exceed 2,500, all eligible entries will move onto the judging round. A maximum of 5,000 entries will be judged to determine the Grand and First Prize winners on or about September 9, 2008, by a panel of judges, whose decisions are final on all matters relating to the Contest. Panel of judges will include etiquette expert and author for the Emily Post Institute, Peggy Post, among others. All eligible entries will be judged, based on the following criteria: Essay Sincerity - 33%; Most Deserving Nominee - 33%; Most Inspirational Story - 34%. In the event of a tie, tied entries will be re-judged based solely on Most Inspirational Story. Grand Prize winner's Nominazor will be notified by phone and mail/fax, by September 12, 2008.
3. Prizes:
Grand Prize (1): Prize selected by Nominator will be awarded to the Nominee, with a value up to $20,000. Prize must be procurable in the United States. Travel may be taken outside of the United States. If actual prize value exceeds $20,000, Grand Prize winner will receive a check for $20,000 and no additional compensation will be provided. Grand Prize will be presented to Nominee in person at Nominee's home by Peggy Post and a TV crew (if available) and Nominee will be verified as eligible on the morning of National Thank You Day, September 22, 2008. Nominator and Grand Prize Winner must be available on September 22, 2008, or prize will be forfeited and an alternate winner will be determined. If Nominator resides 100 miles or more from Nominee, Sponsor will provide Nominator with a 3-day/2-night trip to Nominee's hometown, including round-trip coach class air transportation from the major airport nearest Nominator's residence to the major airport nearest Nominee's residence, hotel accommodations (based on one room, single occupancy), and round-trip ground transfers to/from airport/hotel in arrival city [Nominator Trip Approximate Retail Value ("ARV"): $2,400]. Trip must be taken from September 21, 2008 to September 23, 2008 or on dates specified by Sponsor, or prize will be forfeited for both Nominator and Nominee and an alternate winner will be determined. At Sponsor's sole discretion, prize may be presented on a morning news show on National Thank You Day, instead of at nominee's home. If so, both Nominator and Nominee must be present at the location of the morning show which could potentially be anywhere in the continental United States. Sponsor will provide round-trip coach class air transportation from major airport(s) nearest Nominee's and Nominator's residences, hotel accommodations (based on double occupancy) for 2 nights and round-trip ground transportation to/from airport/hotel in destination city. If Sponsor decides to award this trip, Nominator and Nominee must both travel from September 21, 2008 through September 23, 2008, or prize will be forfeited and an alternate winner will be determined (Trip to morning show ARV: $5,000). Maximum ARV of complete prize is $25,000. First Prizes (100): A signed book from etiquette expert and author for the Emily Post Institute, Peggy Post and a 14 oz. Box of merci Finest Assortment of European Chocolates (ARV: $29.94 each). Prizes will be awarded to the Nominees.
4. General Rules:
By submitting an entry, you represent: (a) that the entry is your own original work that has not previously been published or publicly shown or won a prize or award and (b) the entry does not infringe, misappropriate or violate the rights of any third party including, but not limited to, copyright, trademark, or other intellectual property rights, rights of publicity or privacy or defamation, or portrayal in a false light. Further, any entry submission deemed inappropriate by Sponsor, in its sole discretion, will be disqualified. All entries submitted become the property of the Sponsor and will not be acknowledged or returned. Entrants acknowledge and agree that their entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use entries in any way they see fit in connection with advertising or promoting the Contest in any medium, throughout the world, in perpetuity. No information regarding entries or judging will be disclosed. Sponsor, its affiliates, subsidiaries and advertising and promotion agencies assume no liability or responsibility for any claim arising in connection with participation in this promotion or a prize awarded. Winner/Nominator assume all liability for any injury or damage caused, or claimed to be caused including computer malfunction, by participation in this promotion or by use or redemption of any prize or by any related activities. Taxes, related to the Grand Prize, are the responsibility of the winner. Taxes, related to the Nominator's trip prize (if applicable), are the responsibility of the Nominator. Administrator will make three attempts to contact potential Grand Prize winner's Nominator within 48 hours from time that the judging is completed. If Administrator is unable to reach the potential Grand Prize winner's Nominator within this time frame, the Grand Prize winner will be disqualified and an alternate will be determined. Grand Prize winner's Nominator will be required to sign and return an Affidavit of Eligibility and Liability Release, Assignment of Rights and Publicity Release (where legal) and attest to the fact that winner is eligible and will be available to receive his/her prize on National Thank You Day (and travel to the Sponsor-selected morning news show, if applicable), within 3 days of notification attempt or prize will forfeited and an alternate Nominator/Nominee will be determined. Affidavit will be sent via overnight UPS with a pre-paid UPS overnight return enclosed and/or will be faxed and Nominator may return his/her executed Affidavit via fax and then send the hard copy via UPS. Return of prize or prize notification as undeliverable may result in disqualification and alternate determination. Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability and Publicity Release (where legal) when presented with the prize (or prior to travel if the Sponsor-selected trip to the location of a morning news show is awarded). Acceptance of prize constitutes permission to use winner's and Nominator's names, photographs, likenesses, entry, video footage, and geographical data for advertising and promotional purposes in any media throughout the world, without further notice, right of review or approval or compensation except where prohibited by law. Prizes are non-transferable/no substitution allowed except by Sponsor who reserves right to award a prize of equal or greater value if selected prize or portion of prize is unavailable. If selected prize is not obtainable, Sponsor reserves the right to award a cash equivalent, in its sole discretion. If a trip is selected as the prize, air transportation must be from major airport in the United States nearest winner's home to the destination city. For Grand Prize, morning news show trip or Nominator trip prize (if any are applicable), airline carrier's regulations and conditions apply. Trips may not be combined with any other offer and travel may not qualify for frequent flyer miles. Travel companion(s) of the Grand Prize winner, if any, will be required to execute a Release of Liability prior to departure. Grand Prize winner and travel companion(s) (or Nominator) must possess valid travel documents (i.e., valid passport, valid photo ID) in order to travel. Certain restrictions and blackout dates may apply for Grand Prize trip. Seat selection and timing of trip subject to availability and confirmation of reservations. No refunds or credit for changes are allowed. Grand Prize travel, if applicable, must be completed within one year from the date awarded or, on date specified by Sponsor in the case that an event is selected as the prize (or if the nominator travels or there is the morning news show trip). Dates of departure and return are subject to change. If an event is selected for the Grand Prize winner, but it is cancelled or postponed due to circumstances beyond Sponsor's control, that portion of the prize will not be awarded and no additional compensation will be provided. If a car is selected as the prize, Grand Prize winner is solely responsible for all applicable taxes, insurance, licensing, registration, title fees and pick-up costs. Grand Prize winner may be required to show proof of insurance and a valid driver's license prior to taking delivery and pick up vehicle as directed by Sponsor. Any additional vehicle options that are not standard on make and model of vehicle listed in prize description are the sole expense of winner, unless the total value is still $20,000 or less. Dealership is at sole discretion of Sponsor. If a car lease is selected as the prize, Grand Prize winner is responsible for any scheduled maintenance of the vehicle during the length of the lease. Winner is responsible for excess wear and tear and for mileage over the agreed upon number of miles at the agreed upon cents/mile. Subject to credit approval and insurability determined by the dealer. Grand Prize winner must enter a contract with the dealer and must comply with all applicable leasing terms as set forth in lease contract. Grand Prize winner must show proof of adequate insurance coverage prior to taking possession of vehicle. Additional restrictions, at Sponsor's sole discretion, may apply depending on the prize selected. If Nominator resides less than 100 miles from Nominee, Nominator will be responsible for transportation to/from Nominator's residence at his/her own expense and no additional compensation will be provided. By entering, Nominator and Nominee (by knowledge of entry) accept and agree to be bound by these official rules and the decisions of the judges. Internet entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or website, violates the Official Rules, or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Please note: any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate or by any human error which may occur in the processing of the entries in this Contest. Sponsor reserves the right to cancel the Contest if it becomes technically corrupted, and award prizes from eligible entries received prior to cancellation. As a condition of entering the Contest, Nominee and Nominator (or parent/legal guardian if Nominee or Nominator is a minor in his/her state of residence) agree that: 1) under no circumstance will Nominee or Nominator be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.
5. Eligibility:
Nominator and Nominee must be legal residents of the U.S., 18 years of age or older as of Nominator's date of entry. Professional writers (anyone who has been paid for their writing in the last 12 months) and employees and their families of Storck USA, L.P., wkpr, LLC, their affiliates, subsidiaries, advertising and promotion agencies and Don Jagoda Associates, Inc. are not eligible. This Contest is void where prohibited and is subject to all federal, state and local laws.
